Welcome to my web site. Here, I can introduce myself and tell you why I am running for Berrien County Commissioner 9th District.
I have lived in New Buffalo since 1999, but have regularly visited southwest Berrien county since the early 1960's.
Since moving here in 1999, I have witnessed and have myself  been a subject of numerous government abuses in this area by government bureaucrats. In many instances the municipal enforcement officers don't use the appropriate ordinances to harsass individuals. All of these persecutions have cost both the victims and the taxpayers. It is my firm belief that the methods and processes used by local code enforcement officials are contrary to government's main purpose in protecting property and one's individual rights secured by both federal and  our state constitutions.
 
Who am I?
In the past I was a carpenter, remodeler, contractor, mechanic.. I've pretty much done it all in the blue collar sector. I've worked union gigs and freelanced as well. I have some college but have mainly been self taught and a graduate of the school of hard knocks. I've seen many injustices and in the past , have placed myself in harm's way to help the downtrodden. Although I respect and support civil disobedience in order to get an abusive government's attention, I no longer practice it. I believe in the view of the founders  and support the declaration of rights in the original Michigan constitution which alignes with its federal conterpart.. In essence, I believe in small government,  expect few non-essencial  services, especailly social ones from the governent and an abundance of individual liberties.  I understand the federal governmnet is broke and believe the county should rely little if any on federal grants and subsidies. My intention is not to legislate, but delegislate and  return to the people what the county deprives them of not bin entitlements but in individual liberties.
  
Victims of governental abuse
Without significant financial resources most people don't stand a chance once government involves itself in their lives. Whether it's code enforcement, traffic stop harassment, children/ family services or any other issues, walking into any hearing or court without hiring an attorney is  a losing battle. Submission is the only option. Appearing in court should not have to be a terrifying experience for the defendant, but by design, it is.  This is one of the  reasons I am running for this office .Commissioners can have significant input in policy.
Although many people do not realize this, the county commissioners control the purse strings for funding all the countywide agencies. So the commissioners control the policy for these agencies as well. This is where serious change can occur. As they say, "money talks"

Fully informed Juries  and self representation
Jurors, although most don't know it, are the most powerful people in a court room. A single juror can control a defendant's destiny, but are they aware of their power to not only rule on the guilt or innocence of a defendant, but also to rule on the constitutionality and morality of the law itself,  known as nullification?
Jurors can vote their conscience and judge both the fact and the law and contrary to most jury instructions isseud by the judge. In some states bills are pending to compel judges to notify juries of this as it is the standing law of the land. In other states laws have been passed allowing attorneys to inform  jurors of their power.I believ jurors whoa re asked to serve in Berrien county should be fully aware of all their rights.
In addition, many precedents have been established for pro-se amd pro-per litigants, where the courts have an obligation to not only assist individual non attorney litigants, but to lower the bar in procedural standards when they plead their cases.
Policies such as these would further level the playing field for victims of governmental abuse.  I propose more accountability from judges and a non-judicial, non-attorney  citizen review board concerning their actions.
All in all, changes such as these partnered with treatment programs for substance abuse, staffed with recovering addicts, rather than jailtime could drastically reduce the jail population as the United States has the highest per capita incarceration rate in the world.
 
 The truly most important issue, " Our individual rights"
Since 9-11, most members of congress have been voting in ways that are determental to the rights secured to us by both the Federal constitution and its Michigan counterpart. Beginning with the Patriot Act, which was written many years before 9-11, and subseqeuntly ending with the most recent National Defense Authorization Act in which some provisions allow for the indefinate detainment of United States citizens. On the heels of this atrocious piece of legislation is the introduction of the Enemy Expatriation Act designed to strip US citizens of citizenship  and do so without any due process. It seems that these erosions of our civil liberties are accelerating  while the press barely mentions it. Although at the federal level, our so-called representatives are stripping us of our rights, we have little recourse but to turn to our local officials who have taken oaths of office to support and defend the constitutions; both Federal and State. The Declaration of Rights in the Michigan constitution is harmonious with the Federal version and it is, in my opinion, the duty of all elected officials within the state to honor, support and defend the provisions set forth in that document. Under the 9th and 10th Amendments, the federal government can not exceed the autority defined in Article I sec 8  and has no right whatsoever to deny any American citizen  any rights enumerated in the Bill of Rights. To deny any one of them simply negated the rest. I would hold any county official, elected or appointed , responible for crimes against the people if they were to allow  federal government agents to come in to Berrien County and deprive any Berrien County citizen due process under law. If our Federal repsesentaives can't follow the golden rule, the basis and foundation of this nation, then our local officials must and I promise that I will fight for these rights over any other issue that may arise.   I don't have a lot of the answers , but am willing to work diligenty in finding constitutional solutions for issues concerning the people of Berrien county. This is who I am and I would be honored in accepting your support and helping to save this great nation.

Upton votes Yea on indefinate detention bill which Obama signs into law

Ninety three US senators including both Michigan senators and 273 congressman including our very own Fred Upton voted for the passage of the annually renewed NDAA ( National Defense Authorization Act), but this year's is more sinister in nature than teh previous years.

Turns out that provisions in the act such as sec 1021 and sec 1022 allow for the indefinate detainment of American citizens based on vaguely worded criteria,  while including the war on terror

I urge any reader to do his own reserach on this and upcoming Enemy Expatriation Act HR3166 AND S1698  designed to work with the former as well as with the Patriot Act andMmilitary Commissions Act; All designed to destroy any semblence of liberty Americans have left.

In a barely publicized signing on New Year's eve 2011, Obama  added a signing statement to the bill stating that although he holds the power to exercise the power granted the military in the bill, he will not use it.

It's time to wake up and hold all OUR elected officials accountable for what they are doing to us. If the federal government has the authority to take us away while ignoring our rights secured by the Us Constitution then we have to look at our local officials, such as the County Sheriff and other State officials to make sure our rights under the Michigan State constitution are protected since all state and county officials have taken an oath of office to support and defend both. I have already asked State representative Al Pscholka if he was ready to defend his constituency against this federal tyranny and at the public Twin Cities Tea Party meeting Thursday Jan 12th and he stated that he would. I will be asking Sheriff Bailey if he will be doing the same in the near future..stay tuned.

Update Oct 14. 2011 Card holders with guns and providers are criminals

AP Oct 4th, a California dispensary was sued for 2.4 million dollars by the IRS  for  illegal drug trafficking.

AP  Sept 29th,  BATF assistant director Arthur Herbert stated that it is illegal for medical marijuana users to purchase firearms or ammunition.

As of that date, per the statement, everyone in Michigan who has a card and a gun is considered a criminal. This was bound to happen because our so-called representatives do not address the issue at the federal level and did not allow the Paul /Frank bill to go to comittee and a vote to get out of the prohibition business and allow this issue to be dealt with at the state level.  Despite the Obama administrations promises as quoted by the Honorable Fred Upton, the feds are going after people who operate within the laws that the states/ people designated.

 This issue was brought up to an Upton Aide at the Twin Cities Tea party meeting on Oct 13th, but the aide stated that congress is just too busy to deal with such an issue at this time.. Busy? Busy doing what?

Enough is enough Fred.. do the right thing. Get the federal government out of the prohibition business and let the states deal with it!

Commissioner Administrative meeting
Last week I had the opportunity to attend my first County Commissioner meeting as I sat in on the administrative committee meeting. It was the first order of business as Chief judge Butzbaugh went to bat for an employee on his staff who had taken on additional duties and responsibilities as he explained  it. This was due to the departure of the previous employee who had left the state. With very little discussion the small panel of three commissioners ultimately agreed that a flat 10% raise for the additional duties was required and ultimately approved by the committee. Just like that! Great working for the county and having a dept head go to bat for you,isnt it? How many of you out there in the real world got a 10% raise just like that? It wasn't the judges money was it? All this in just one meeting in one committee in one visit. $50 million will sure go fast at that rate.

Upton on federal marijuana legalization

Recently a federal bill HR2306 for the legization of marijuana was introduced in the house by Ron Paul/ Barney Frank. This bill called for the federal government to get out of the business of marijuana prosecutions and leave the issue up to the states. So far 14 States have legalized medical marijuana, Michigan being one of them.  Fred Upton is the Federal representative of the people in this district and I contacted him asking him to support and co-sponsor this bill.

Here is the reply he sent to me:

Dear Ray:

Thank you for your message in support of legislation to legalize marijuana. I welcome the opportunity to respond.

 While it is unlikely that Congress will be considering such legislation this year, I would note that on October 19, 2009, the U.S. Department of Justice stated that it will no longer prosecute individuals who use or distribute marijuana for medical purposes, so long as they act in accordance with state law.

As you may know, Michigan is one of 14 states in the country that make some allowance for the medicinal use of marijuana. The voters of southwest Michigan overwhelmingly supported the statewide medicinal marijuana initiative on the November 2008 ballot and there have been no efforts in the Congress to interfere with that initiative.

 I do want to thank you for contacting me. As one who has always personally read and signed all of my mail, it really is important for me to stay in touch with the 700,000 that I represent in southwest Michigan .

Jobs and the economy remain my TOP priority. It is not the government that creates jobs, it is the private sector. During these tough economic times, I continue to do all I can to help businesses, large and small, add jobs.

I also know that with a $14.3 trillion-yes, that is trillion-national debt, we cannot as a nation continue to spend money that we do not have and borrow $58,000 every second. I continue to focus on spending issues, knowing that raising taxes is not the right answer, particularly here in Michigan . I also am encouraged that the House will indeed address tax reform and make the complex tax code simpler, while not allowing individuals or businesses to be exempt from paying their fair share.

As the new Chairman of the Energy and Commerce Committee, I believe most Americans understand the concept of supply and demand. We consume 19 million barrels of oil every day and produce only 7 milion. Oil prices will only continue to climb higher as world consumption grows more than a million barrels a day each year. I support alternative forms of energy but know that we cannot put safe drilling in the Gulf and other parts of America off-limits. I also prefer tapping into Canada 's oil sands rather than having them sell to China . I remain committed to putting our country's best interests ahead of politics.

 So that's it?  Obama said he wouldn't prosecute and Congress will not discuss this issue? That falls pretty short of what is neccessary. Congress may not have interfered, but it should. Federally, marijuana caregivers who make a profit selling marijuana have to claim the income on federal tax returns. This income is illegally obtained by federal standards and is a federal crime to sell marijuana. Despite the fact that it is legal to sell limited amounts to approved individuals within this state. This is somethng that must be addressed at the federal level. The feds should get out of this business entirely and let the states regulate this entirely On another note, Mr. Upton brings up the issue and the importance of Michigan jobs and energy as he chairs energy committees as well and to blow this off not acceptable and leaves to many issues in limbo.

Mr. Upton, Marijuana is the largest cash crop in the country. It has numerous commercial uses  which include raw material for  paper, rope, clothing and most importantly fuel known as butenol, a gasolene-like substitute with more similarities than ethanol. Imagine how much Michigan farmers would be able to produce and what a boost the state economy would get if these options were pursued by private enterprise  and the federal government got out of the way. I think you should reconsider your opinion on this matter and have congress address this issue ASAP!
